1. Purpose

​

VIAJE ATÍPICO S.R.L., hereinafter referred to as “the Agency,” is an inbound travel agency specializing in organizing tailor-made trips to Costa Rica, with a share capital of 500,000 ₡ (Costa Rican colón).

​

The natural person making the payment for the organization of a trip is hereinafter referred to as “the Client.”
 

​The natural persons who will participate in the trip are hereinafter referred to as “the Travelers.”

​

These GTCS apply to all bookings and contracts concluded with the Agency. They describe the rights and obligations of the Agency and the Client. The Client acknowledges having read and accepted the GTCS at the time of the first payment.

2. Prices

​

On the website https://www.atipico-costarica.com, prices are indicated in € (Euro) and per person. These prices are provided for information purposes only and are subject to change, for example depending on the time of year, the number of travelers, the quality of accommodation, etc.​​

​

The applicable prices are those shown on the quote sent by the Agency to the Customer. They are valid for 30 days from the date of issue of the quote.
 

3. Quote requests

​

The Agency specializes in organizing tailor-made trips to Costa Rica and allows users of its website to request quotes free of charge.

​

The data collected on this occasion is used exclusively for the purpose of creating personalized itineraries and is not disclosed, exchanged, or sold to third parties under any circumstances.
​

4. Confirmation

​

After agreeing on all services, the Customer must email the Agency a copy of the passports and travel documents of all Travelers.

​

In order to confirm the organization of the trip, the Client must pay a deposit of 30% of the quote amount to the Agency. Payment of this deposit constitutes acceptance of the services agreed upon by both parties.

​

The balance of the invoice shall be payable 60 days prior to the Travelers' arrival. For any trip organized less than 60 days prior to the departure date, the entire invoice must be paid to confirm the reservation.
​

5. Payment terms

​

Payment for services is made by bank transfer.

​

Any bank charges applied by the Customer's bank are payable by the Customer.

​

6. Cancellations

​

Any cancellation made by the Customer before the start of the trip must be communicated by email to the Agency, which will acknowledge receipt. The Agency will then proceed with the modifications or partial or total cancellation of the trip.

​

The Agency does not provide cancellation insurance. The Customer is encouraged to take out cancellation insurance covering sudden, unforeseeable, justified events beyond the control of the Travelers.

​

Cancellation fees:

​

• Up to 60 days before the arrival date: 20% of the amount of the services concerned.

• Between 59 and 30 days before arrival date: 35% of the amount of the services concerned.

• Between 29 and 15 days before arrival date: 50% of the amount of the services concerned.

• Between 14 and 7 days before arrival date: 70% of the amount of the services concerned.

• Less than 7 days / no-show: 100% of the amount of the services concerned.
   

7. No-show

​

In the event of a no-show by one or more Travelers on the scheduled date of departure or start of services, no refund will be granted and the full amount of the trip will remain due.

8. Changes

​

After confirmation of the trip, the Agency reserves the right to charge administrative fees for any changes to the agreed services.

​

9. Insurance

​

The services offered by the Agency do not include travel insurance. It is strongly recommended that the Customer take out insurance covering the risks associated with cancellation or interruption of stay, civil liability, damage or accidents, medical expenses, missed flights, and loss or delay of luggage.

The Agency cannot be held liable for any costs incurred by Travelers in the event of an accident, illness, or any other unforeseen situation. Travelers must ensure that their insurance coverage is appropriate for their needs and destination.

10. Minors and health conditions

​

Minors must be accompanied by a responsible adult throughout the trip.

​

Travelers must consult a healthcare professional to ensure they are fit to participate in the activities booked. The Agency must be informed in advance of any special medical conditions so that services can be adapted, if possible.

11. Responsibility (documents, vaccinations, luggage)

​

Travelers are responsible for having a valid travel document to stay in Costa Rica. Some countries require a visa even for stopovers.

 

They are also responsible for ensuring that they are up to date with any mandatory vaccinations that may be required by the Costa Rican authorities.

 

The Agency declines all responsibility in the event of loss, theft, or damage to luggage during the trip.
 

12. Responsibility of service providers

The Agency acts as an intermediary between the Customer and the various service providers (transport companies, hotels, guides, etc.). It cannot be held responsible for the poor performance or non-performance of services booked with these service providers, except in the case of direct fault on the part of the Agency.

 

13. International flights
 

Unless expressly agreed otherwise, the Agency does not cover the purchase of international flights to or from Costa Rica. The Customer is responsible for booking these tickets. No compensation may be claimed in the event of delays or cancellations of international flights.

 

14. Force majeure and exceptional circumstances
 

The Agency cannot be held liable for changes, postponements, or cancellations caused by events of force majeure: natural disasters, epidemics, government decisions, political unrest, strikes, exceptional weather conditions, or any other unforeseeable event.
 

In such cases, costs already incurred with service providers may only be reimbursed if the latter agree to do so.
 

15. Personal data
 

In the context of organizing trips, the Agency collects and processes personal data (contact details, copies of passports, travel documents, etc.). This information is used solely for the preparation and management of trips.
 

It is never sold or communicated to third parties other than the service providers involved in organizing the trip.
 

The Customer has the right to access, rectify, and delete their data, which they may exercise by emailing the Agency.
 

16. Complaints

 

In the event of a complaint regarding the services provided by the Agency, the Client must immediately inform the Agency by telephone or email, providing all relevant details.

 

If the complaint cannot be resolved amicably, the Client must send an email to info@atipico-costarica.com.
 

The Agency undertakes to respond within a maximum of 30 days from receipt of the complaint.

 

In the event of a dispute, the parties undertake to seek an amicable solution. Failing this, any dispute relating to these GTCS shall be submitted to the competent courts of San José. These GTCS are governed by the law of Costa Rica.

17. Revision of the GTCS

 

The Agency reserves the right to modify or update its GTCS at any time and without notice. The applicable version is the one in force on the day of the trip confirmation.
